ABSTRACT

This research examines the methodological thot of Nasr Hamid Abu Zaid (1943–2010) in the development of a contemporary Quranic hermeneutics approach and its implications for the study of Islamic family law. The issue underlying this research is the gap between the provisions of Islamic family law, which are read textually-normatively, and the social dynamics of modern society that require responsive and contextual solutions. The Compilation of Islamic Law as a guideline in the Indonesian religious court system requires an adaptive reinterpretation, especially concerning gender relations, polygamy, inheritance, and women’s rights. The method used is library research of a qualitative-descriptive-analytical nature with primary sources from Abu Zaid’s writings and academic responses from contemporary Muslim scholars. The analytical approach uses hermeneutics as a scalpel to dissect ideological readings of the Quranic text. The research results show that Abu Zaid’s thot is built from the meeting of Islamic-Arab heritage and the Western modern-humanist approach, which gives birth to a model of productive reading (al qira’ah al-muntijah). This approach distinguishes ma’na as literal-historical meaning and maghza as the significance of the ultimate goal, thus being able to trace the historical roots of gender bias in classical exegesis tradition. The application to the issue of polygamy shows that the provision is not the ultimate goal of Sharia but rather a temporal decree with difficult-to-fulfill conditions, thus its significance is gender justice. Abu Zaid’s contribution also sparked controversy due to concerns about the desacralization of sacred texts and interpretative relativism. Thus, Abu Zaid’s thot can serve as a methodological framework for gradually updating Islamic family law provisions to be responsive to contemporary challenges without abandoning their theological roots.
